Position Overview
Litigation paralegal primarily responsible for Employment Litigation docket. Provides support to corporate attorneys. Under the direction of corporate attorneys, resolves routine legal issues and matters. Conducts legal research and analysis of statutes, regulations, case law, and other applicable legal sources. Assists in the preparation of legal documents (e.g., affidavits, briefs, memoranda, contracts, letters, etc.). Generally performs a variety of legally oriented tasks for the benefit of the Company. Provides occasional administrative support on an as-needed basis to the Deputy General Counsels and Chief Legal Officer.
Requirements
Essential Functions
- Perform all elements of litigation case management, including file management, discovery, and trial activities.
- Legal File Management (organize and maintain filing, index system, archiving and record retention).
- Use Legal Tracker to keep case files updated, including opening matters, reviewing case updates, and coordinating with outside counsel.
- Correspond with location/corporate staff, outside counsel, and others on factual matters.
- Conduct preliminary fact investigations, including review, analysis and organization of Company factual data/information.
- Index and/or summarize documents as requested.
- Assist in preparing location/corporate staff for depositions, court hearings and other proceedings.
- Review/draft responses to interrogatories, requests for admission, production of documents and other documents.
- Draft pleadings, affidavits, and other filings as needed.
- Review briefs and legal memoranda for accuracy of factual info.
- Proofread documents and pleadings as needed.
- Receive, analyze and coordinate response to subpoenas, employee, and patient record requests. Work with other legal department paralegals, People Services, Clinical, and Facilities to triage third-party requests and subpoenas.
- Maintain calendar/tickler system in Outlook. Maintain litigation docketing calendar.
- Research law and secondary material, including procedural, administrative, or case law as requested.
- Prepare draft litigation summaries for internal legal team and for ultimate distribution to outside independent auditors as requested.
- Draft and facilitate litigation holds. Work with OpenText system to transmit and maintain litigation holds.
- Manage the receipt, approval, and payment of invoices from outside counsel and vendors.
- Track outside legal and corporate costs and prepare necessary reports.
- Review, document and file releases and/or settlement documents.
- Assist with preparation for (and attend as requested) settlement conferences, mediations, and hearings
- Draft, mail and file correspondence for attorneys.
Employment Litigation
- Responsible for investigating EEOC/Discrimination Claims and/or Attorney Demand Letters; DOL Audits/Investigation and other Wage Claims to include collection/preservation of documents, interview potential witnesses, research case law related to allegations and preparation of responses. Identify potential trends and/or systemic behavior in employment issues; work with People Services to resolve trends/systemic issues to ensure compliance with applicable state/federal laws and company policies and procedures.
- Responsible for timely reporting EPL matters to insurance carriers, general administrative tasks associated with electronic maintenance of files.
- Responsible for responding to investigative subpoenas and requests from Boards of Nursing, State Regulatory Licensing and
- Reporting Agencies, Office of Inspector General, Office of Attorney General, Grand Jury and other investigative agencies to include collection/preservation of documents and compilation of responses; discernment of information to be released and redactions where necessary and required; confidentiality of requests and timely compliance with producing information requested.
- Responsible for responding to ROIs/subpoenas for employee records and ADL requests under CA Labor Code to include collection of documents and compilation of responses; discernment of information to be released after review, redactions where necessary and interpretation of subpoena; timely compliance with producing information requested. Research state specific laws and company specific policy guidelines for release of employee information. Provide guidance to field People Services personnel where required for personnel file construction and maintenance.
Requirements
- At least five years of legal experience, preferably in a corporate law department managing litigation.
- Ability to perform a wide variety of administrative and paralegal tasks.
- Experience with all stages of litigation, including intake, discovery, and trial.
- Experience preparing for and attending trials/arbitrations/hearings/mediation.
- Experience developing and maintaining processes to collect, store, and maintain paper and electronic case files.
- Proficient with cite-checking and Bluebook rules.
- Experience with court and administrative agency filings, including electronic or e-filings.
- Experience using e-discovery databases (e.g. Relativity).
- Experience using litigation support software for managing files and transcripts preferred.
- Proficient with Microsoft Office software products including Word, Excel, Outlook and PowerPoint
- Proficiency using LexisNexis, Westlaw, and Adobe Acrobat in a legal setting.
- Must be available for travel as needed.
- ABA paralegal certification.
Preferences
- Experience with healthcare, medical malpractice litigation preferred.
- Experience with Legal Tracker is strongly preferred.
- Experience with OpenText litigation hold management tool.
- Experience with e-billing and invoicing.
- BS/BA or JD from an accredited college or university is strongly preferred.
